Proctor's punishment at life and Lemell's punishment at sixty-five (65) years and a Five Thousand Dollar ($5,000.00) fine. On direct appeal, the appellants maintained their convictions were barred by jeopardy. The Eleventh Court of Appeals agreed,
reversed and ordered the prosecutions dismissed. Proctor v. State, 806 S.W.2d 252 (Tex.App. - Eastland 1990); Lemell v. State,
